10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTOAI INTERNATIONAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless BestoAi International, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of third parties.

12. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any disputes arising out of or related to these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

12.3 Arbitration

Before initiating any legal proceedings, the parties agree to attempt to resolve any dispute through good faith negotiations for a period of thirty (30) days.

13. Third-Party Services

Our services may integrate with or contain links to third-party services, websites, or applications. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

14. Service Level Agreement (SLA)

15. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to embargo or designated as a "terrorist supporting" country.

16. Miscellaneous

16.1 Entire Agreement

These Terms constitute the entire agreement between you and BestoAi International regarding our services and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, or government actions.
